Questions we hear

Do we need a U.S. entity before a sponsor bank will talk to us?

Often, yes. Sponsor banks generally expect a U.S. entity with clear ownership, a named compliance lead and the registrations it needs, such as FinCEN MSB registration and any required state money transmitter licenses. Your counsel advises on the entity itself. See money transmitter licensing.

Which sanctions lists will a U.S. bank expect us to screen against?

OFAC first: the SDN List, OFAC's other lists, and entities owned 50 percent or more, in the aggregate, by blocked persons. Corridor banks commonly add U.K., E.U. and U.N. lists, plus any your home regulator requires. See sanctions screening.

Do you replace our local counsel?

Why do U.S. banks exit African payment corridors?
